These Terms and Conditions of Service ("Terms of Service") govern your usership on Tripscapade.com and their associated mobile sites (the "Tripscapade.com" or the "Sites") and your purchases and use of products and services available through Tripscapade. General

By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms of Service. Capitalized terms are defined in this Agreement. By contacting and participating on Tripscapade.com, I represent that I am at least 18 years old legally able to enter contracts.

This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Mumbai, India, without giving effect to any principles of conflicts of law.

 

Intellectual Property

 

The Site and its original content, features and functionality are owned by Tripscapade and are protected by  intellectual property or proprietary rights laws.

 

Termination

We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

 

Links To Other Sites

Our Site may contain links to third-party sites that are not owned or controlled by Tripscapade.Tripscapade has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.

 

Privacy Notice

A copy of the Privacy Notice that applies to the collection, use, disclosure and other processing of personal information by Tripscapade is located at www.tripscapade.com. Your consent to any personal information we may obtain about you (either via theTripscapade site, by email, telephone or any other means) being collected, stored and otherwise processed in accordance with the terms of the Privacy Notice. Tripscapade may update its Privacy Notice from time to time in its sole discretion, and post an updated version of the notice at the website address provided above.

 

Order Processing

Tripscapade may, in its sole discretion, choose to not process or to cancel your reservation in certain circumstances. This may occur, for example, when the booking you wish to reserve is no longer available or has been mispriced, we suspect the reservation request is fraudulent, or in other circumstances Tripscapade deems appropriate in its sole discretion. Tripscapade also reserves the right, in its sole discretion, to take steps to verify your identity to process your reservation. Tripscapade  will either not charge you or refund the Charges for reservations that we do not process or cancel.

 

Product and Service Availability

In rare cases, a hotel, trip or event may be available when a customer places the order, but becomes unavailable prior to check-in. If this should occur, your sole remedy shall be to contact tripscapade to make alternative arrangements or to cancel your reservation.

 

Product and Service Descriptions

​

Tripscapade tries to provide accurate descriptions of products and services on Tripscapade Sites. Tripscapade does not warrant, however, that the descriptions are accurate, complete, reliable, current or error-free.

 

Special Requests

​

If you have any special requests in connection with your Tripscapade itinerary, you must submit them on Tripscapade Request a Quote page at the time you book your reservation. We will pass along any requests we deem reasonable to the relevant service providers. We cannot guarantee, however, that the service providers will fulfil such requests; as such services or amenities may not be available. Tripscapade is not liable for any failure to fulfil a special request, and no cancelation due to any special request not being met shall be allowed. If a request is made after a quote is given, Tripscapade reserves the right to increase the fees.

Tripscapade strives to provide accurate pricing information regarding the products and services described in Tripscapade custom itineraries. We cannot, however, insure against pricing errors or pricing changes. Tripscapade reserves the right, at its sole discretion, to not process or cancel any bookings placed for a product or service whose price was (1) incorrectly provided as a result of an error, or (2) changed by the service provider. If this occurs, Tripscapade will notify you by email and correct the pricing on the itinerary. If additional charges apply to your booking (including but not limited to the addition of an extra traveller, resort fees or other taxes or incidentals), which charges you do not pay at the time of checkout on Tripscapade Sites, you will be responsible for paying these charges directly to the service provider. Tripscapade does not guarantee that it offers best available rates for products and services available.

 

Changes To This Agreement

We reserve the right, at our sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Service.

Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.

 

Cancellations and Changes to Itinerary

Once a customer signs off on a completed Tripscapade itinerary, free changes cannot be made. If a trip is cancelled after the first draft of the completed itinerary is complete, you will be responsible for the full itinerary price. All refunds will be paid in the currency in which you originally paid for the booking. You may not sell, auction, barter, share or transfer your itinerary to a third party.

 

Taxes and Fees

​

The sales or other taxes charged in connection with your booking depend on the location of the event, property or service provider, any rules governing those service providers, or other requirements. Service providers may also charge service fees. You will be able to view the taxes and additional service fees included in a booking before confirming the booking.

Service Provider Rules and Restrictions

Service providers may impose additional rules and restrictions on products and services booked on the Tripscapade itinerary. Please read these additional terms and conditions carefully. By purchasing products and services through Tripscapade you agree to abide by such additional rules and restrictions, such as the payment of all amounts when due and compliance with the service provider's rules and restrictions regarding availability, minimum age, maximum occupancy, pet policies, child policies and use of fares, products or services. You agree that any violation of any such service provider's rules and restrictions may result in cancellation of your reservation, in being denied access to the applicable travel products or services, in forfeiting any Charges (defined below) paid for such reservation, and in being charged by Tripscapade for any costs we incur as a result of such violation.

 

Incidentals

​

Tripscapade bookings do not include any incidental charges, expenses or services, except as specifically described in your itinerary. You are liable for any such incidental charges, expenses or services that you incur or consume during your trip.

 

Payment

​

ALL RESERVATIONS BOOKED THROUGH TRIPSCAPADE MUST BE PAID IN FULL. YOU AGREE TO PAY TO TRIPSCAPADE THE FEES, COSTS, EXPENSES AND OTHER CHARGES IN CONNECTION WITH YOUR RESERVATION (COLLECTIVELY, THE "CHARGES"). YOU ACKNOWLEDGE AND AGREE THAT THE CHARGES WILL BE BILLED TO YOUR PAYMENT CARD, OR THAT YOU WILL PAY THE CHARGES USING ANOTHER PAYMENT METHOD APPROVED BY TRIPSCAPADE.

 

Insurance

​

GIVEN THE NATURE OF TRAVEL SERVICES, WE RECOMMEND THAT YOU OBTAIN INDEPENDENT INSURANCE TO PROVIDE ADEQUATE COVER FOR MEDICAL EXPENSES, PERSONAL ACCIDENT, LOSS OF BAGGAGE AND CURTAILMENT OR CANCELLATION OF YOUR TRIP. PLEASE NOTE THAT SUCH INSURANCE IS NOT INCLUDED WITH YOUR PURCHASE ON THE TRIPSCAPADE UNLESS YOU SEPARATELY PURCHASE SUCH INSURANCE ON TRIPSCAPADE SITES.
